Nortel Quote of the Day

“Nobody is safe, unless you are working in [Parliament Hill], I guess,” “We worked all our lives for this and it’s just been pulled out from underneath us.”

- Bob Dowson, 68, who retired from Nortel’s Brampton office after 32 years, during a rally yesterday by Nortel employees and pensions in front of Parliament Hill yesterday in Ottawa. His $30,000/year pension could be reduced by 30% because Nortel’s pension plan in under-funded.

Good on these people for stepping up and taking a stand on this very important issue that affects not just ex-Nortellers, but the country at large.

Let's hope our d*ck-useless government actually does something for these people who have worked hard over the years and are watching their retirement get taken out from under them.

  • less

Caring politicos will ask themselves: How many votes might speaking for a few old Nortel dinos garner?

  • zeroman

not a big group so does not really matter to the shrews. the new boat arrivals are of bigger interest because of a larger ethnic vote. sucks but this is reality.

only a fast tracked lawsuit against government will get things moving.

  • Resigned_From_NT

True, although I think this may become more of a nation-wide issue than just a Nortel one. I suspect there are a lot of DB plans out there that are seriously under water.

As noted below, the reality is that in Canada today, this won't get the attention of the voters, which is just sad.

  • Casual_Observer

“We feel that our future is totally up in the air,” Sutton said, recalling that one of Nortel's draws was its total compensation package.

“So that was a big enticement to stay with Nortel. We now realize we were mugs,” he said, standing next to his wife Anna, who said, “Maybe if (Prime Minster Stephen) Harper and (Finance Minister Jim) Flaherty had their pensions on the line they would have some sympathy.”

How ironic…he stays at Nortel all these years because of compensation but now complains that he isn't getting compensated long after not working. A pension is a failed idea. Perhaps if Bob and others had 401ks and learned how to manage their money instead of expecting someone else to do it for them, they could have taken more control over their lives. From what I hear, many in Richardson and elsewhere are busy learning new skills to manage their money full well knowing the pension system isn't something they can count on. Pensions just don't work.

  • less

    ?
Thats not what the global village abroad says about pensions; ditto free and universal health care.

  • nortelex

True but it could have been worse if Bob listened to Nortel's lies and invest his 401K in NT stock.

    Many did….

  • bankrupt_bob

    …Yes, we did.

  • Casual_Observer

Putting all your eggs in one basket is poor risk management. It doesn't take a genius to figure that out. I worked there for a number of years and it seemed to me many in Canada drank whatever was given to them – personal consequences be damned. And no one ever told me to invest in NT stock.

I do think the Canadian government should do something to help Nortel pensioners but the reason many companies are dissolving pensions is because we no longer live a world where a company will be around for a lifetime and the liabilities far exceed what the company can provide since there will be always be business cycles and fluctuations due to competition and other market forces.

  • Casual_Observer

Both are misguided. If your willing to give up your liberty and freedom, I suppose anything is possible but as we all know, there are no things in life that come free without consequences.

  • havequestions

Can I walk out of the office now and ask for goveronments to guarante my job in Nortel as I have whole family to raise? My 40 wks EI income will much less CPP+OAS +70%Pesion.

Don't get me wrong. I support the rally. Just want to know where to draw the line.

BTW,Does ontario still have pension benefits guarantee fund in place?

  • Damos

In Canada, when you are part of a Pension Plan, it severly limits your RRSP (cnadian retirement savings plan) contribution ability. These people were put in a position were there long term saving ability was more limited than those without a Pension plan, and now have no way to recoup the lost investment years.
Would they have invested? Maybe. Could they have invested in other things? Possibly, investment options were not the same 25 years ago as they are today.
I do hope there is some sort of resolution, Nortel's situation is symptomatic of many companies underfunded persions in Canada today. The alternative is that the govt will be supporting these people through OAS or some other means

  • Damos

This is getting lots of press nationwide, and will get a lot of boomers thinking “What about my pension? what if my company goes under?” Boomers are still the largest demographic group, and have a lot of voting power everywhere in the country.. I think it quite possible that this will carry quite a bit of weight in a number of ridings, especially with the federal Conservative party looking to go from minority government to a majority government…

  • zeroman

there were many who believed the 'good buy at this price' stories from Roth, Owens and Z. so their investment plans almost went to zero.

I would think Z can be sued for making those statements of buying stock in the teens when all the time business was tanking.

Pensioners will not get much from billboards and talking. Legal action is the only tactic.

  • NortelTragedy

Regardless of “a pension is a failed idea” that was his agreement with the company as part of his compensation.

I believe a class-action civil lawsuit should go against personally Roth, Dunn, Owens, Zafirovski and each and every person in the BoD and CEO Cabinet going back to 1999 to target their profits defrauded from Nortel. Proceeds should go to employees, shareholders (many employees), and suppliers beginning with the smallest claims.

  • zeroman

the pension funds are like a ponzi scheme since deductions from new employees are used to pay off retired ones because the funds were not being funded and were losing money. this will not change so pretty much stuck at 60%. Gov sees it as a huge liability so they will not do anything.

  • freqmgr

I am not sticking up for Nortel….but at least in my 401k experience I had to ask to have my contribution go to NT stock. Otherwise it went to a “stable value” fund. Not exciting at the time but, when I cashed out, the only one that was in the black. Even with a 401k you have to make your own decisions. I know a number of folks who had millions on paper….by investing in NT stock. And did not move it 7 – 8 years ago when things started coming apart.

  • fatzoff

I agree Z should be sued for comments. Not only causing some to buy Nortel but others continuing to hold shares based on his 'rose colored glasses” comments.

  • less

Putting all your eggs in one basket is poor risk management. A pension is a failed idea

Signing legal agreements with a company the age, size and repute of Nortel – indeed and an honest company of any size – should amount to more than a one-sided “buyer beware”, “trust, but verify” cliche, the equivalent of buying a raffle ticket at the office party.

By that measure any place I signed up for said 401k could pull the same “ya snooze ya loose, sucker” tactic as Nortel and it would be my fault for getting greedy.

(Some dude named) Layton speaks out:

    http://www.theglobeandmail.com/news/politics/nd

Mr. Layton called for the Conservative government to double the Canada Pension Plan benefit to $1817 a month from $908, which several seniors' groups have been lobbying for in recent years.

The proposals come one day after retired employees of the bankrupt telecom giant Nortel held a demonstration on Parliament Hill.

NORTEL is mentioned; Canada's recognized global leader in bankruptcy.

Employees are currently last in line as Nortel sells its assets.

They are calling for the government to intervene and reform the Bankruptcy Act, allowing them to become secured creditors. That would make them eligible for payment ahead of others who are owed money.

The federal government has so far rejected the plea, saying that Nortel's pension plan is provincially-regulated and it's up to the Ontario government to take action.

Industry Minister Tony Clement pointed to Quebec, which has offered to manage the Nortel pension plan for members there until asset values rebound.

Liberal Leader Michael Ignatieff told demonstrators he supports amending the Bankruptcy Act so the pensioners can get what is owing to them.

    I'd take a job here in the US demo-ing the R&D labs…

  • http://nortelinsider.wordpress.com/ Desk Jockey

Ch.11 bankruptcy has become a cheap out for dirty executives to loot the corpse of the very company they destroyed. No where else is this more evident than with Nortel.

Witness the corrupt actions of one Richard Lowe who withdrew $1.7 million from the deferred compensation fund two months before Ch.11 and the subsequent freeze of those assets under bankruptcy laws. Other workers who didn't have inside information were denied access to the deferred compensation fund after Ch.11.

Why would Lowe suddenly decide to withdraw so much money from the fund and take a huge income tax hit only mere weeks before Ch.11? These are the questions that need to be answered.

Even more outrageous is the fact that Lowe is likely one of the benefits of a million dollar KEIP bonus, obtained after Ch.11 while others were being denied severance, having their pensions slashed and LTD put at risk.

And yet Lowe still has the guts to say Nortel still owes him nearly $700K:
    http://www.von.com/news/nortel-wireless-prez-sa…

It is true that greed knows no bounds, and it is sad to see so many suffer because of it.

  • yes4aapl

I have been reading publicly abailable reports.
If I knew that Nortel would not survive beyond the year 2008 anyone inside would know it better than me. In November they were just choosing the date for BK.
Nortel lied to analysts many times. Single digit growth expected for 2008 was the big one and repeated many times. Margin improvemnts is an another example.

Im just gonna say what a lot of people feel ( but are afraid to say) about Lowe, Z, Hackey and the rest of these crooks and evil SOBs…I wonder why anyone hasn't threatened these guys yet….are they so above the law and everything else….They walk around without a care or fear in the world and even flaunt their greed by going to the courts for more while the stressed LTD people try and figure out if they will have enough money for cancer medication….when are these folks going to get justice? I remember when people picketed the home of the AIG crooks in the US…just to scare the crap out of them a bit…….anyone know where these guys live??

  • GoProto

One place screaming for reform is the uncehecked ability to file under CH11, without ever having to prove or really show intent that you are indeed planning to re-structure, and how. The restructuring plan should be a prerequisite, IMO, or at the very least, there should be a deadline for filing the plan, if not, you are booted to CH7. Everyone should realize by now that they used CH11 as a cover all along, just to suck more money out of the company, and never had any intention, or performed any actions whatsoever that differed from a liquidation. This to me, is just another fraudelent act, to add to all of the others. It should be stopped, and no other comapny should be able to rape their employees, ex-employees and shareholders in this way again.

  • protosphere

“Nortel lied to analysts many times.”

Insider only CFOs please…before Binning (the bankruptcy pro with Marconni), for all they didn't know they would fold earlier as they pleaing clueless in common defense, always missing red flags.

Ironically after the largest fraud settlement in Canada, under ultimatum, where they refused to negotiate exorbitant pay practices, and which they tanked anyways with further downplayed revisions by a CEO who defrauded his past employer on several written occasions from day one, all they could come up with was charging Binning and Mike Z with misleading, by leaving largest asset as a tax credit on books they sought to clean for so long… they even had to force CEO to attend government inquiry by subpoena.

“Nortel used their disclaimer as the self proclaimed right to lie.”
Under the protection of “Safe Harbor” too as they delayed repair of books so long their pals at the SEC stepped in, before going under bankruptcy protection. Always protected, even OSC fines them nothing. Open season on investor with OSC farce who's head gets paid a multiple of SEC's to do less. Honest lawyers at corrupt OSC lose careers!

Recently 2 year penalty laws heralded as a breakthrough in Canadian law when they can walk after 4 months for stealing over a million dollars. That is a lot of money a week rewarded to crooks to go to jail.

    ex_nortel_engineer asks:

“are they so above the law and everything else.”
Powerful lawyers, circumventing loopholes, plea bargains, ultimatums… beyond belief, liberties extended to be seen…might make one think so

“when are these folks going to get justice?”
Fraud trials loom on both sides of the border for few older fall guys at crime scene, another handful or 2 were charged only after formal RCMP probe a few years ago but not before, ex-board member Manley's law firm defends Frank Dunn, hyping exoneration as much as Nortel hyped 3 to 5 year turnaround, $20 buying opportunity, with astounding actions like promoting than firing criminally charged pal after CEO defrauds from day one or getting bonuses approved after bankruptcy to denying they knew… always denying they know…after one lie led to so many more to pay a premium for a new fall guy not at the crime scene after a high profile board member tries to diffuse one of the largest frauds on earth, perhaps the largest with this level of mass orchestration for fraud bonuses, ones they even fought to keep at a kangaroo AGM

Increased lawsuit insurance premiums recently to $300M that get paid first like their legal fees and ironically trading losing options for for cash yet again, remaining few board members geting a raise… as we hear they can do whatever they want in commentary following Hackney's road rage incident.

Enough legal power by our some of our most respected members of society to rewrite the laws of physics. Who will challenge them? The public purse? This isn't the USA, unfortunately.

    ________________________________________________________________

Pensions is only the tip of the iceberg…. there are also severances… as defrauded shareholders suffer like Enron's surprise… Nortel disappears now for all the good ultimatums and sweeping all sins under the rug did them…

MANY LAWS NEED CHANGING IN CANADA! …or wait until the next fraud privy to Canadian companies… Ebbers and Skilling got 24 and 25 years… Mike Z gets nothing but charged so far, Dunn will be unlucky to see 7 yrs. walking in only a few at worse, as shareholders and employees chronically suffer the rest of their days for what far from destitue powerful pigs at the trough did…because they could for all the deterent shame provides.

    http://www.allaboutnortel.com/2009/05/26/anothe…

The lawsuit alleges between May 2, 2008 and September 17, 2008, Nortel “failed to disclose material adverse facts about the Company’s true financial condition, business and prospects”. The complaint cites Nortel CEO Mike Zafirovski and CFO Pavi Binning as defendants.

In particular, Coughlin Stoia alleges that Nortel failed to disclose that:

    (i) demand for the Company’s products was declining as carriers cut back their capital expenditures and other customers deferred purchase decisions;

    (ii) that the Company’s financial results were materially overstated as the Company was failing to properly write-down its goodwill;

    (iii) that the Company’s restructuring was not meeting with success as the Company was struggling to cut costs and improve profitability;

(iv) and as a result of the foregoing, defendants lacked a reasonable basis for their positive statements about the Company, its business, operations, earnings and prospects.

Coughlin Stoia is probably best known for being the sole lead counsel to represent the interests of Enron investors.

Our government's hands are tied by law. Nortel exploited and exploits these laws.
Laws that are difficult to change as to how they might effect other honest companies yet Nortel's powerful lawyers prey on these very confines from printing paper to neglecting severances to paying bonuses and even ultimatum settlements they tank, promoting pals over veterans, endless tyranny on steroids.

A will strong enough that dragged these flamboyant tyrants to a government inquiry that was as fruitless as the initial Eichmann trials… missing the endless details and meat of the matter!

Until the U.S. Department of Justice moves on this, expect nothing, they are the ONLY one who know what to ask and look for… ONLY ones….bar none!

Nortel quote of the day.. The facts made simple…if it looks like a duck, walks like a duck, quacks… don't let Nortel feed you it is an eagle. Nortel lies.

-spent hours inventing ambiguous term for fraud, (“for cause”) before endless delays in silence
-then still presenting books wrong again down to the wire, further delayed repair s they downplayed revisions for further periods after ultimatum fraud settlement where they voted to keep fraud bonuses
-past plea bargained bored meetings evangelicalizing no flies on us, claiming no one could not see red flags for immediate untraditional cash they approved and received as they trade options for cash yet again now, pay bonuses than severances, and remaining board members get a raise as old CEOs burden with whopper claims. increase lawsuit ins., try and dodge inquiry, etc…
-few fall guys for this level of mass orchestration with accounting boss Don Dunn, a few more fall guys only after RCMP probe, many more coming in the USA I suspect
-Insider only CFOs before Marconni's bankruptcy Binning when claiming they didn't know they would fold earlier….
-Manley's law firm defends Dunn even stranger…as CEO is questioned by Ottawa how they could cut severances while still paying bonuses
-CEO paid a premium due to lying to past employer who passed him by, promoted little girl assaulting criminally charged Hack over veteran, and hypes a storm in PR craze, also claiming clueless. hiding behind kids education like Mulrooney, or Dunn trying to dismiss on jurisdictional grounds like Nortel..with their crooked templates of what to say…
…it is endless, we can go on forever, as they combat ambiguities with misleading after one lie led to so many more…

bottom line is greed and corruption with victims and unfathomable untold damage

Now what are they prepared to do as Al Copone movie said… leave it to our stronger and braver big brother that Greenspan doesn't like with harsher laws?
